Terms of Service

These terms are the agreement between you and Premier Code, Inc. ("we", "us") for the use of UptimeCraft. By creating an account or using the service you accept them. If you are agreeing on behalf of a company, you are confirming that you may bind it.

1. What the service does

UptimeCraft checks addresses you nominate, from the regions you choose, and tells you when they stop responding as expected. It can also wait for scheduled jobs to report in, publish status pages, and send alerts to destinations you configure.

2. Your account

Keep your credentials to yourself and tell us promptly if you think someone else has them. You are responsible for what happens under your account, including anything your team members do.

Heartbeat ping URLs are credentials too. Anyone holding one can report that your job ran successfully, which would suppress an alert you were relying on. Treat them as secrets, and regenerate one if it leaks.

3. What you may monitor

This one matters. You may only point UptimeCraft at systems you own or are authorised to test. The service sends real network traffic — HTTP requests, TCP connections, ICMP echoes, DNS queries and UDP probes — from our infrastructure to whatever address you enter. Using it against systems you do not have permission to probe may be unlawful, and it is grounds for us to close your account without notice.

4. Plans, billing and cancellation

Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices are in US dollars and exclude any tax we are required to add.

You can cancel at any time from your billing settings. Cancelling stops the next renewal; your plan continues until the end of the period you have already paid for. We do not give partial refunds for unused time, though if something has genuinely gone wrong, write to us and we will deal with it sensibly.

If a payment fails we may suspend paid features until it succeeds. We will give you notice before changing prices, and a price change never applies to a period you have already paid for.

5. The free plan

The free plan is offered as-is, with lower limits and no promise of availability. We may change or withdraw it, and we may suspend free accounts that have been inactive for a long period — with notice by email before anything is deleted.

6. What we do not promise

A monitoring service can fail to notice an outage, or report one that is not happening. Checks depend on networks we do not control; alerts depend on email providers, chat platforms and webhooks we do not control; and any monitor can be misconfigured. UptimeCraft is a useful signal, not a guarantee. Do not rely on it as the sole safeguard for anything where a missed alert would be catastrophic.

We aim to keep the service running continuously and to alert promptly, but except where a separate written service level agreement says otherwise, we do not commit to a specific level of uptime, alert latency or check frequency.

7. Your data

Your monitors, results and content remain yours. You grant us only the permission needed to run the service: to store your configuration, perform the checks you ask for, record the results, and send alerts where you tell us to. Our Privacy Policy explains how we handle it.

You can export or delete your data at any time. Closing your account deletes it, subject to the retention described in the privacy policy.

8. Availability and changes

We improve the service continuously, which means features may change. We will not remove something you depend on without reasonable notice. Maintenance that we expect to interrupt monitoring will be announced in advance where we can.

9. Suspension and termination

You may stop using the service and close your account at any time. We may suspend or close an account that breaches these terms, that is being used to harm others, or where we are required to by law. Except for serious or unlawful misuse, we will tell you why and give you a chance to put it right.

10. Disclaimers and liability

To the fullest extent the law allows, the service is provided "as is" and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We are not liable for indirect or consequential loss, lost profits, lost revenue, lost data or business interruption — including losses arising from an outage we failed to detect or an alert that did not arrive. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded, such as for death or personal injury caused by negligence, or for fraud.

11. Indemnity

You will cover us against claims arising from your use of the service in breach of these terms, and in particular from monitoring any system you were not authorised to monitor.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, and its courts have exclusive jurisdiction, without affecting any mandatory rights you have where you live.

13. Changes to these terms

If we make a material change we will email account holders and update the date at the top before it takes effect. Continuing to use the service after that means you accept the new terms; if you do not, you can cancel.
